GENERAL TERMS AND CONDITIONS OF SALEThese conditions apply to all sales concluded with the Château de Comiac, Route de Comiac, 30610 Saint Jean de Crieulon. As the result, the customer acknowledges having read these general conditions of sale and undertakes to respect them.
These conditions of sale are modifiable at any time and the conditions applicable will be those in force on the date when the reservation will be carried out.
SECTION 1 - PRICE OF THE STAYRates shown are in €uro and include tax and consider the VAT applicable on the day of booking. Any change in the applicable rate, or any modification or introduction of new legal fees introduced by the competent autorities, will automaticallyaffect the prices indicated on the date of invoicing.
No contestation regarding the price of the stay can be considered after the signing of the contract. It is up to the tenant to appreciate, before the signature if the price suits him.
Extras are not included in the price of the rental, they will be billable extra when you leave.
The tourist tax is included in the price.
For departures after the time noted on the contract, a rate scale will be added to the rental rate (20€ per hour).
SECTION 2 - RESERVATION, CONTRACT AND DEPOSITAfter receiving your reservation, we will send you a rental contract by email or post on request together with these Terms et Conditions.The amount of the booking, extras, any charges and security deposits are indicated on your contract.
We invite you to return, within the time indicated on the contract signed, the General Conditions of Sale signed and the booking deposit of an amount equal to 30% of the stay.
Once the contract signed and the deposit received, the reservation becomes firm and final.
A confirmation email will e send.
By signing the contract and paying the deposit, you confirm your full agreement with the General Terms and Conditions of Sale specified below.
Please note that without the payment of the deposit within deadline, the reservation is not confirmed and therefore we reserve the right to recover the accomodation.
If the amount of the deposit is made during the booking, the balance of the stay, extras and deposits are payable upon delivery of the keys, upon arrival.
Payment of the balance is made either in cash, by bank check or bank transfer. An invoice can be issued on request.
For Non-French residents, the payment of the deposit must always be made by transfer to the bank account attached to your contract, all bank charges remaining chargeable to the payer.
The reservation is firm and final only after receipt of the confirmation sent to the customer by the central reservations (Booking, Expedia, AirBnB,etc...) and the payment of the deposit.
The full payment of the stay is made directly to the owner.
To secure the booking, the deposit will be made :
- by check payable to SCEA Château de Comiac and sent to the address Château de Comiac, route de Comiac 30610 Saint Jean de Crieulon
- by cash sent to the address Château de Comiac, route de Comiac 30610 Saint Jean de Crieulon
- by Bank Transfer (IBAN attached)
In this case, the reservation becomes firm and final only upon receipt of the deposit by the owner, within the time limits.
Payment of the balance of the stay will be made on site at the owner.
Le Château de Comiac accepts the following Credit Cards : VISA, MASTERCARD.
SECTION 3 - FORCE MAJEUREBy force majeure is mean any event external to the parts presenting a character at once unpredictable and insurmontable which prevents the customer in the realization oh the trip , to execute or a part of the obligations envisaged by the contract. This will be particulary the case regarding to aggraved medical reason, government riots or public.
SECTON 4 - TIME OF STAYThe tenant rents our accomodation for a specified period, written on the contract, and cannot under any circonstances claim any right to maintain the premises.
In general, the lease may not be extended without the prior written consent of the owner, the tenant thus accepting.
The lease automatically ceases upon the expiry of the fixed them (subject to status schedule of fixtures implemented).
For departures after the schedule note on the contract, a rate schedule will be added to the rental rate.
SETION 5 - CANCELLATIONThe tenant can cancel his rent at any time. However, we draw your attention to the consequences of cancelling a reservation of accomodation. It entails the perception of variable costs according to the date on which in intervenes.
The following price scale is applicable, at the expense of the tenant :
- you cancel between 90 and 31 days before entering the premises, the cancellation fee will 30% of the amount of your rental ;
- you cancel between 30 and 16 days before entering the premises, the cancellation fee will be 75% of the amount of your rental ;
- you cancel less than 15 days before entering the premises, the cancellation fee will 100% of the amount of your rental.
Whatever the reasons for the cancellation, the tenant must notify the owner by letter or email, the date of receipt of this notice determining the scale to apply. The tenant not having warned the owner would be held to full settlement of the balance.
If a case of force majeure led to the impossibility of providing housing (water damage or various damage, climatic hazards, etc...), all the sums paid would be refunded to the tenant, without him being able to claim subsequent refunds. In case of cancellation, except in cases of force majeure, and on the initiative of the owner, it reinburses 100% of the sums collected.
Any interrupted or abbreviated stay, or any service not consumed, gives rise to no refund. Even in the event of repatriation, it is up to the renter to take out an appropriate insurance.
SECTION 6 - DEPOSITSFor all furnished rentals a deposit is required (deposit). This deposit must be paid on the day of arrival. If is not cashed, except in case of damage. It is returned after the inventory or, at most, within 15 days after the end of the lease.
A second deposit is required for housekeeping. This deposit must be paid on the day of arrival. It is also not cashed unless the house in not returned in the state of cleanliness it has been given.
The tenant agrees to use the rented premises with care. The tenant will assume, in addition to the rental fees, any damage caused to the accomodation, as well as the cost of replacement of any object lost, destroyed or deteriorated.
The renter is liable for any damagee that he or the perons accompanying him may cause intentionally or negligently.
SECTION 7 - ARRIVAL AND DEPARTUREThe property receives the tenant for check-in. The tenant must be present on the day specified at the time of his reservation, at the earliest at 16:00 (time of availability of the accomodation and time of delivery of the keys) and, at the latest, at 19:00. The tenant will inform the establishment imperatively in advance, by phone at +33(0)6.35.57.31.78. or by email chateaudecomiac@gmail.com, of his time of arrival so that we can be organized and be present to receive it during the home time slot.
The inventory and departure must take place before 10:00. For this, please make an appointment with the owner as soon as possible. We insist on the respect of the agreed time when making an appointment for the inventory of fixtures : cleaning is done over a very short period of time and on several housings for disinfection, we ask you to facilitate the task, as we asked the tenants who preceded you.
SECTION 8 - OCCUPATION OF PLACESThe accomodation must not, under any circonstances, be occupied by many people greater than that indicated on the contract, unless prior and exceptional agreement of the owner. If necessary, the owner may claim an additional rent, or even refuse to make the accomodation available if he cannot ensure that the tenant will respect the maximun number of persons provided for the rental of the accomodation and in this case, no reimbursement whatsoever to the tenant can be considered.
If you rent several of our accomodations, it is strictly forbidden to group together in a single house. You assume your responsibility in the event of an accident.
SECTION 9 - OBLIGATIONS OF THE ESTABLISHMENTChâteau de Comiac is required to :
- deliver the rented premises in good condition for use and repairs, as well as the equipment mentioned in the contract in good working order.
- ensure the tenant the peaceful enjoyment of the rented premises and guarantee vices and defects of a nature to obstruct.
- maintain housing in a state of service for the intended use.
- provide towels and bed linen to tenants.
SECTION 10 - OBLIGATION OF THE TENANTThe accomodation is provided to the tenant in a clean and tidy condition, the appliances are clean and in perfect working order (otherwise notify the owner), places (inside and outside) have no mark degradation of any kind.
The tenant is obliged to :
- recognize that the seasonal rental is entered as a temporary and recreational residence. The premises cannot be used a a main or even secondary dweling and the tenant cannot engage in any commercial, craft or professionnal activity.
- behave in the rules of etiquette together and ensure the proper maintenance of housing during his stay.
- return the home in the initial state of cleanliness and stored at the end of its stay (washing and storage of clean and dry dishes, sheets and towels collected in the Anett bag at the entrance of the house, household appliances cleaned, floors vacuumed and washed, kitchen, toilet and bathroom bins emptied into the black container and cleaned, recycling disposed near the black container, etc...). If these conditions are not respected, the cleaning deposit will be cashed by the establishment.
- use furniture and movable objects for their normal uses fo which they are intended. Those who, at the end of the lease, are missing, have not been maintained or have been taken out of service, for reasons other than normal wear and tear, will have to paid (or replaced by the tenant with the authorization from the owner). This clause also applies to painted walls, door frames and the building in general (interior and exterior).
- Leave the furniture and dishes inside the house (no exchange between housing and no chair or dishes or other indoor object left outside.
- do not sleep on the mattress, bedding, blankets ou duvets. It will be retained if necessary the price of washing or cleaning blankets, quits, mattresses, bedding, etc...that would have been stained.
- Do nothing that, because of it or the fact of his family or his relations, can harm the tranquility of the neighbourhood or other occupants.
- absolutely abstain from throwing in sinks, baths, showers, sinks, toilets, etc...objects likely to obstruct the pipes (diapers, wipes, Tampax, cotton buds, sanitary napkins, etc.), for lack of what, it will be indebted of the expenses engendered for the restoration of these apparatuses.
- immediately inform the owner of all external visits, the establishment being private.
- respond to damage and losses that occur by his own act or by the fact of person in is house, during the enjoyment of housing, unless it proves that they occured without his fault or that people sus-designated.
- in case of hogh heat in summer, as is done in any home, close the shutters and windows of the housing during the day to keep it as cold as possible, then open at night or at night whole (closed shutters), to bring in the freshness and renew the air.
- during strong winds, please close the shutters.
SECTION 11 - NUISANCE
The owner cannot be held responsible for the neighbourhood and their animals.
The owner cannot be held responsible for possible presence of mosquitoes and various insects, or irregularities and/or lack of enjoyment that may occur in the electricity service (cutting WIFI in case of wind and/or bad weather), mobile, etc...and disclaims any liability for lack of enjoyment not coming from his fact.
Similary, the owner cannot be held responsible for the time, preventing the tenant to fully enjoy his stay.
SECTION 12 - ANIMALSL'establishment reserves the right to refuse animals due to the presence of animals on site (dogs, cat and geese). In case of no respect, the owner may refuse the rental and therefore no reimbursement will be considered.
SECTION 13 - STATE OF ENTRANCE/EXIT, INVENTORYThe inventory is established contradictorily between the parties, at the entrance to the premises of the tenant and the release of premises by the tenant. In this respect, it is specified that furniture and movable objects must suffer only from the depreciation resulting from the normal use for which they are intended. any objects, equipment or household equipment lost, broken, damaged or damaged must be replaced or refunded at its replacement value by the tenant who requires it.
SECTION 14 - EXTRASExtras are proposed as an appendix to your rental :
- breafasts cost €10 per person per day (free for children under 5 years old). There are presented on a tray.
- the change of bedsheets and towels durins the rental week will be charged €10 per bed and €4 per person for towels.
- a cleaning service of departure can be chosen by the tenant : €80 for the Floraison (Flowering) Cottage, €60 for the Nouaison Cottage and for the Veraison Cottage and €40 for the Le Chai (The Cellar) Cottage. The provision of this optional benefit means for a dwelling left in a normal state of rental use, respect and regular maintenance during the stay. The deposit then left on arrival will be cashed.
- baby equipment kit : high chair and travel cot available on request.
- for a late departure, the tenant will be charged €20 per additional hour.
- laundry : washing + dryer : €10
- loss of key is charged €70.
SECTION 15 - RESPONSABILITIES
The establishment declines all responsability in the event of theft, loss or damage to the belongings of guests during their stay.
The customer will be held responsible for any damage, degradation or vandalism that may occur due to the occupancy of the premises and/or because of the participants and/or the staff in his charge, both movable, decorative and real estate property belonging or not to the establishment. As a result, the establishment may therefore ask the client to leave the guest roomwithout any compensation and without any refund of the current stay, and to reimburse the damage caused by his actions.
The owner disclaims all liability in case of accident.
SECTION 16 - COMPUTERS AND FREEDOM
In application of the law 78-17, known as IT and freedoms, customers are warned that their reseration is the subject of a computerized registered treatment. The users have a right of access and rectification of the entered data, which is exerted with the head office : SCEA Château de Comiac, route de Comiac 30610 Saint Jean de Crieulon France. It is specified that this information is not communicated to third parties.
The establishment offers WIFI internet access. the client user agrees that the computer ressources made available are in no way used for the purpose of reproduction, representation, provision or communication of the public of works or objects protected by a copyright, by a neighbouring right such as tects, images photographs, audio-visual musical works, software and video games, without the authorization of the holders of the rights provided for in Books I and II of the Intellectual Property Code when this authorization is required.
Château de Comiac has a video surveillance system in the public areas of the building and the car park.
SECTION 17 - APPLICABLE LAW
These General Terms and Conditions of Sale are governed by French law. This is so for the substantive rules as for the rules of form. Litigation will fall under the exclusive jurisdiction of the French courts.
